Rental Terms & Agreement

Rental Terms and Conditions

  1. Payment in full is required upon reservation – License and Insurance must be verified before handoff of the vehicle.
  2. An authorization will be placed on the card upon pickup and released upon safe return of the vehicle.
  3. Your rental includes a free mileage of 300 miles/day. Mileage is counted as sum total of entire trip. Excess miles will be charged at a rate of $0.85/additional mile at the end of the trip.
  4. Our cars are equipped with USB memory sticks that allow for sentry mode and dashcam footage storage for your safety during your trip. These options can be turned off through the main screen if you'd like, however, tampering, removal, or loss of USB memory device will result in a $100 replacement fine.
  5. You assume full financial responsibility for the vehicle and any third party damages that occur during your trip while the vehicle is in Your care, custody and control except to the extent arising out of or resulting from the gross negligence or any latent, hidden or other product defects or product liability or malfunction with respect to the Vehicle. You are responsible for any fees and charges incurred during your trip (tolls, fines, charging fees if applicable, charger idle fees, etc.). Absolutely no smoking or pets. Any violations will be subject to a fee in accordance with the damages assessed.
  6. You must demonstrate sufficient insurance coverage for the car you are renting for the actual cash value. You may provide your own insurance – subject to our approval – or purchase insurance through through the extras section. You are not required to purchase insurance from us as a condition for the rental.
  7. Upon booking, we will send you detailed instructions on car use, pickup, documentation, and insurance procedures.
  8. Failure to pick up the rented car within 6 hours from the reservation start time will result in a no-show status, and no refunds will be provided.
  9. We reserve the right to decline renting our cars to any person at anytime. If we decline your rental request all payments made to us will be refunded to you in full.
  10. Cancellation: You may cancel the reservation for a full refund up to 48 hours after the time of booking or 24 hours from the reservation time for "short notice" trips (booked within 2 days of start date). Trips cancelled after that time will receive a refund of 50% of the rental cost.
  11. Changes: Please contact us. We will strive to accommodate changes, subject to cars' availability.

Financial Responsibility Notice

  1. While the Vehicle is in Your care, custody and control, You are responsible for all collision damage to the vehicle, even if someone else caused it or the cause is unknown except to the extent arising out of the gross negligence or any latent, hidden, or other defects or product liability or malfunction with respect to the Vehicle. You are responsible for the cost of repair up to the value of the Vehicle, towing, storage, and impound fees. Your own insurance, or the issuer of the credit card you use to pay for the rental may cover all or part of your financial responsibility for damage to, or loss of, the rented vehicle.
  2. You should check with your insurance company, or credit card issuer, to find out about your coverage and the amount of deductible, if any, for which you may be liable. If you use a credit card that provides coverage for your responsibility for damage to, or loss of, the Vehicle, you should check with the issuer to determine whether or not you must first exhaust the coverage limits of your own insurance before the credit card coverage applies. We will not hold you responsible for damage caused by collision or upset if you buy Collision Damage Waiver (CDW). But, CDW will not protect you if you commit any of the acts listed in Paragraph 5 of the Terms and Conditions.
  3. The purchase of optional insurance products is not required to rent the Vehicle. Optional insurance products that we sell may provide coverage that duplicates coverage provided by your personal automobile liability policy or by another source of coverage.
  4. We are not qualified to evaluate the extent of your existing auto liability coverage. Optional insurance products are provided under individual policies issued to you, or issued to you under a group or master policy issued to us by an insurer authorized to transact the applicable insurance business.

Rental Agreement

  1. Definitions. “Agreement” means all terms and conditions found on both sides of this form. “You” or “your” means the person identified as the renter on the reverse side of this Agreement, any person signing this Agreement, anyAuthorized Driver and any person or organization to whom charges are billed by us at its or your direction. All persons referred to as “you” or “your” are jointly and severally bound by this agreement. “We”, “our”, "Company" or “us” means Eon - an Eon company. “Authorized Driver” means: the renter; the renter’s spouse; the renter’s employer and coworker if engaged in business activity with the renter while using the Vehicle, and, any additional driver and listed by us on this Agreement, provided that each such person has a valid driver’s license and is at least age 21. “Vehicle” means the automobile or truck identified in this Agreement and any vehicle we substitute for it, all its tires, tools, accessories, equipment, keys and Vehicle documents. “CDW” means Collision Damage Waiver
  2. Rental, Indemnity and Warranties. This Agreement is for the rental of the Vehicle. You agree to indemnify us, defend us and hold us harmless from and against all verifiable and substantiated claims, liability, reasonable, actual out-of-pocket costs and reasonable outside attorney fees we incur directly resulting from, or arising out of this rental except to the extent arising out of or as a result of Tesla Rents negligence or willful misconduct. We make no warranties, express, implied or apparent, regarding the Vehicle, no warranty of merchantability.
  3. Condition and Return of Vehicle. You must return the Vehicle to our rental office or other location we specify on the date and time specified in thisAgreement and in the same condition that you received it except for ordinary wear and tear. Service to the Vehicle or replacement of parts or accessories during the rental must have our prior approval which shall not be unreasonably withheld, conditioned or delayed. You will check and maintain all fluid and battery levels, We may lawfully and peacefully repossess the Vehicle at your reasonable, actual verifiable expense with notice to you, if the Vehicle is abandoned or used in violation of applicable law or this Agreement, including but not limited to reckless driving or negligent use of the battery.
  4. Responsibility for Damage or Loss; Reporting to Police. You are responsible for all actual verifiable damage to the Vehicle including the reasonable actual out-of-pocket cost of repair or the retail cash retail value of the Vehicle on the date of the loss if the Vehicle is not repairable or if we elect to sell the Vehicle without repairing it. You are also responsible for missing equipment and our administrative expenses connected with any actual verifiable damage claim in accordance with Cal. Civil Code section 1936. If you fail to exercise ordinary care while in possession of the Vehicle, you are responsible for loss due to theft of the Vehicle and all damage due to vandalism that occurs in connection with a theft. You are responsible for actual verifiable damage due to vandalism not associated with theft of the Vehicle up to a maximum of $500. Allowing a person who is not an Authorized Driver to use the Vehicle is not an exercise of ordinary care, but a willful, and reckless act and is a breach of this agreement. You must report all accidents involving the Vehicle or theft of the Vehicle and vandalism to us and to the police promptly.
  5. Collision Damage Waiver. If you purchase CDW, we waive our right to collect from you for damage to the Vehicle in excess of your stated deductible amount. We will not waive our right to collect from you, if you provided false or fraudulent information to us and we would have not rented the Vehicle had we received true information, or if damage to the Vehicle results from: (a)intentional, willful, wanton, or reckless conduct; (b) operation of the Vehicle under the influence of drugs or alcohol in violation of § 23152 of the CaliforniaVehicle Code; (c) towing or pushing anything; (d) operation of the Vehicle on an unpaved road or if the damage or loss is a direct result of the road or driving conditions; (e) use of the Vehicle for commercial hire; (f) use of theVehicle in connection with conduct that could be properly charged as a felony;(g) use of the Vehicle in a speed test, contest, or driver training activity; (h)operation by a person other than an Authorized Driver; (i) providing false or fraudulent information regarding the cause or circumstance of damage; (j)excessive speeding and / or depleting of the battery to less than 10 miles of range; or, (k) operation outside the United States and Canada.
  6. Battery levels. You acknowledge that depleting the battery to 0 (percent or miles of range) may potentially cause lasting damage to the vehicle's battery and other systems and as such, forfeit your security deposit in the event that you deplete the battery to 0 while it is under your care (i.e. during a rental where you are listed as a driver).
  7. Insurance. You are responsible for all damage or loss you cause to others. You agree to provide auto liability, collision and comprehensive insurance covering you, us, and the Vehicle. Where state law requires us to provide auto liability insurance, or if you have no auto liability insurance, we provide auto liability insurance (the “Policy”) that is secondary to any other valid and collectible insurance whether primary, secondary, excess or contingent. ThePolicy provides bodily injury and property damage liability coverage with limits no higher than minimum levels prescribed by the financial responsibility laws of the State whose laws apply to the loss. You and we reject PIP, medical payments, no-fault and uninsured and under-insured motorist coverage, where permitted by law. Coverage is void if you knowingly violate the terms of this Agreement or if you fail to reasonably cooperate in any loss investigation conducted by us, or our insurer. Giving the vehicle to an unauthorized driver terminates our liability insurance coverage, if any. Our Insurance CDW covers damage up to full vehicle value with a $500 deductible, and has liability coverage up to state minimum.
  8. Charges. You will pay us on demand for all charges due us under this Agreement that are allowed by law, including, but not limited to: (a) time and mileage for the period you keep the Vehicle, or a mileage charge based on our experience if the odometer or its seal is tampered with or disconnected;(b) charges for optional products you elected to purchase from us; (c) fuel, if you return the Vehicle with less fuel than when rented; (d) applicable taxes;(e) all reasonable, actual out-of-pocket expenses we incur recovering the Vehicle if you fail to return it to the renting location, or if we repossess it under the terms of this Agreement; (f)costs, including pre- and post- judgment outside attorney fees, we incur collecting payment from you or otherwise enforcing or defending our rights under thisAgreement; (g) a 2% late payment fee on all amounts past due; (h) $50 or the maximum amount permitted by law, whichever is greater, if you pay us with abad check; and (i) a reasonable fee not to exceed $350 to clean the Vehicle if returned substantially less clean than when rented. (j) late return fees of $50/hour after your scheduled return time. You will pay us or the appropriate government authority all parking, traffic and toll violations, citations, fines, penalties, forfeitures, court costs, towing, storage and impound charges and other expenses involving the Vehicle assessed against us or the Vehicle; if you fail to pay a parking, traffic or toll charge to the charging authority, you will pay us all fees owed to the charging authority plus our administrative fee of $50 for each such violation and $1.50 for each such toll. Any violation of our no smoking policy, including but not limited to any smoke smell in the vehicle or ash found in the car will automatically have a $500 penalty.
  9. Deposit. We may use your deposit to pay any amounts owed to us under this Agreement.
  10. Your Property. You release us, our agents and employees from all verifiable and substantiated third party claims for loss of, or damage to, your personal property or that of any other person, that we received, handled or stored, or that was left or carried in or on the Vehicle or in any service vehicle or in our offices.
  11. Breach of Agreement. The acts listed in paragraph 5, above, are prohibited uses of the Vehicle and, following prior written notice and a reasonable opportunity to cure, breaches of this Agreement.
  12. Modifications. No term of this Agreement can be waived or modified except by a writing that we have signed. To extend the rental period, you must return the Vehicle to our rental office for inspection and written amendment by us of the due-in date. This Agreement constitutes the entire agreement between you and us. All prior representations and agreements between you and us regarding this rental are void.
  13. Miscellaneous. A waiver by us of any breach of this Agreement is not a waiver of any additional breach or waiver of the performance of your obligations under this Agreement. Our acceptance of payment from you or our failure, refusal or neglect to exercise any of our rights under this Agreement does not constitute a waiver of any other provision of this Agreement. Unless prohibited by law, each party hereto release the other from any liability for consequential, special or punitive damages in connection with this rental or reservation of a vehicle.If any provision of this Agreement is deemed void or unenforceable, the remaining provisions are valid and enforceable.
  14. I understand if I have an unpaid balance to Fleetr INC and do not make satisfactory payment arrangements, my account may be placed with an external collection agency. I will be responsible for reimbursement of the fee of any collection agency, which may be based on a percentage at a maximum of 35% of the debt, and all costs and expenses, including reasonable collection and attorney’s fees incurred during collection efforts. In order for Fleetr INC or their designated external collection agency to service my account, and where not prohibited by applicable law, I agree that Fleetr INC and the designated external collection agency are authorized to (i) contact me by telephone at the telephone number(s) I am providing, including wireless telephone numbers, which could result in charges to me, (ii) contact me by sending text messages (message and data rates may apply) or emails, using any email address I provide and (iii) methods of contact may include using pre-recorded/artificial voice message and/or use of an automatic dialing device, as applicable. Furthermore, I consent the designated external collection agency to share personal contact and account related information with third party vendors to communicate account related information via telephone, text, e-mail, and mail notification.

Subscription services

  1. Deposit Policy
    Before vehicle handoff, your card will be authorized for a security deposit to be returned upon the safe return of the vehicle at the end of your subscription. This is separate from the initiation fee. The following amounts will be authorized; $1000 for weekly, $1000 monthly, $1500 for 6+ months.
  2. Payment & Automatic Renewal Policy
    Payments are due every 7 or 30 days, based on your chosen subscription period. Payment for the next period will be billed 3 days before your next period start time. Your subscription will automatically renew at the end of your term unless canceled.
  3. Vehicle Maintenance and Insurance
    Regular vehicle maintenance is included in your subscription. Should routine maintenance be required during your rental, you may be asked to assist with coordinating vehicle inspections or stops at a service center. In such cases, you will be comped two prorated rental days each day you participate in helping with necessary maintenance tasks. For example: if at our direction, you stop by a tire shop to replace the vehicle tires, we will pay for the maintenance and you'll enjoy two free days in the vehicle. While maintenance issues are covered by us, you are still liable for non maintenance damages as may arise from accidents, theft, vandalism, and negligence.
  4. Cancellation policy
    You can cancel your subscription at any time with a 15 day notice for monthly and 6+ months subscriptions and a 7 day notice for weekly subscriptions. If you're on the 6+ month plan and need to end your rental before the first 6 months, your pricing will revert to the monthly rate and any difference in cost between monthly and 6+ months will be withheld from your deposit.
  5. Your subscription constitutes a recurring rental agreement that renews every 7 or 30 days, depending on your selected plan. A complete copy of the rental agreement, including all specific terms and conditions, will be provided to you separately.
